The standard work “Medienregulierung” (Media Regulation) (edited by Hardy Gundlach, formerly together with Wolfgang Seufert) has been published in its third edition by Nomos.

It includes an article by our PI Svenja Hagenhoff on the protection and exploitation of intellectual property:

Hagenhoff, Svenja (2025): Regulierung der Verwertung geistigen Eigentums. In: Hardy Gundlach (Hg.): Medienregulierung. 3 Auflage. Baden-Baden: Nomos, S. 559–594. DOI: 10.5771/9783748914969-559.

The article deals with the protection and exploitation of intellectual property, consisting of intellectual works (copyright and related rights), technical inventions (patent law), and trademarks (trademark and design law). It first explains the conflict of objectives between the interests of controlled exploitation (protection) and those of unrestricted use. It then presents solutions for dealing with this conflict, consisting of formalized rules and prohibitions, organizational approaches (collecting societies and flat-rate levies), and technologies to aid enforcement and implementation. A complex case study using the example of the different value creation structures for printed and electronic books shows how the various aspects are interrelated.
