Out now: “Regulierung der Verwertung geistigen Eigentums”

The authoritative essay collection “Medienregulierung” (Media Regulation) (edited by Hardy Gundlach, formerly together with Wolfgang Seufert) has been published in its third edition by Nomos.

It includes an article by our PI Svenja Hagenhoff on the protection and utilization of intellectual property:

The article covers the protection and utilization of intellectual property, consisting of intellectual works (copyright and related rights), technical inventions (patent law), and trademarks (trademark and design law). It first explains the conflicting aims and interests of controlled utilization (protection) and unrestricted use. It then presents solutions for dealing with this conflict, including formalized rules and prohibitions, organizational approaches (copyright collectives and private copying levy), and technologies to aid enforcement and implementation. A complex case study considering the different value creation structures for printed and electronic books shows how the various aspects are interrelated.
